    Debt Recovery

    Debt recovery is an area in which expert professional assistance is essential. Sometimes this may only require an initial approach by way of a solicitor’s letter; in other cases legal proceedings may need to be issued and served, while in some situations a court hearing is required.

    For debtors we carry out an assessment of all monies owed and produce an action plan as to the most suitable way of dealing with these. The key to resolving debt issues is communication. We can liaise with each of your creditors on your behalf and endeavour to reach settlements which are acceptable to all parties. Usually a client will need some time to think about their options before returning and we will then map out a plan of action.

    For creditors, the amount of the debt will dictate exactly which court proceedings should be issued. It is the District Court for amounts up to €15,000 and then the Circuit court for amounts up to €75,000. The High court then deals with debt cases for amounts over €75,000.

    In cases where proceedings have been issued and there is no formal response from the debtor, then it can be possible to file the appropriate papers with the court office to obtain an automatic judgement. On the other hand, if the case is defended then it can go all the way to trial.

    If a judgement is obtained then the debtor of course will be obliged to pay it. If the debtor still refuses to discharge this, a creditor has a variery of enforcement options. By way of example, this could include instructing the sheriff, obtaining a judgement mortgage, having an attachment of earnings order or a getting a garnishee order.

    Litigation is a relatively broad legal term that essentially covers any kind of legal dispute.
    On 3rd February 2014 the jurisdictions of the Irish courts underwent their largest overhaul in many years. This in turn means that a new and innovative approach is required in many cases.

    The changes are as follows:
    1. The jurisdiction of the District Court in civil proceedings has been increased to €15,000
    2. The jurisdiction of the Circuit court in civil proceedings (other than personal injury claims) has been increased to €75,000
    3. The jurisdiction of the Circuit Court for personal injury cases has been increased to €60,000
    Litigation can encompass many areas. This might be a dispute over a payment, trying to enforce a contract, damage to property by a third party, a partnership dispute, a disagreement over a will or a disagreement over a boundary; these are just some examples.

    A will is a vital document in making sure your intentions are followed in looking after your loved ones after you are gone. It is never too early to make a will, and once done you can be certain that your wishes will be fulfilled when you are no longer around.

    Similarly, if you change your mind as to who you want to leave your assets to, then it is a relatively easy exercise to make a new will.
    If you have not made a will, then intestacy rules will apply on your death. These set out who your assets will pass to and in some situations may benefit someone whom you might feel is undeserving.

    It is also important to know that a marriage invalidates a will, unless the will was made in contemplation of that marriage. The best advice, if recently married, is to make a new will.

    Section 77(1) of the Succession Act 1965 sets out some of the criteria for a will to be valid. The person making the will (testator or testatrix) must be at least 18 years old or married (or been married) and of sound disposing mind. The test in relation to being of sound mind can be summed up as follows:

    • The testator must understand that they are executing a will as a document that will dispose of their assets
    • The testator must know the nature and extent of the property which is being disposed of
    • The testator should consider all of the people who might be expected to benefit and then to decide whether or not to benefit them

    In many ways, medical negligence cases can be seen as a sub branch of Personal Injuries cases. In very general terms, the liability question in medical negligence cases is measured as to whether the medical professional acted within the level of competence of another equivalent medical professional.

    The landmark decision in this area derives from the 1989 case Dunne v The National Maternity Hospital. This sets out the test for establishing negligence in diagnosis or treatment on the part of a medical practitioner. Broadly this is whether the practitioner has been guilty of such failures as no medical practitioner of equal specialist or general status and skill would be guilty of if acting with ordinary care. Unlike personal injury matters, medical negligence cases are not submitted to the Personal Injuries Assessment Board and proceedings can be issued without delay once the appropriate reports have been obtained. The issue of quantum is dealt with in much the same way and by applying the same principles as a personal injury case.

To preserve independence, the specialist will often be a UK based consultant. Our first step in instructing the specialist will be to furnish him or her with your complete set of medical notes.     The majority of personal injury cases arise from road traffic accidents or from workplace incidents.
    Irish law takes what is known as a ‘fault based’ approach in this area. Accordingly the first question to be determined is liability i.e. who was at fault?

    This is measured by a standard of proof known as the ‘balance of probabilities’, for example, is it more likely than not that the other party is to blame? The second question to turn to relates to ‘quantum’ which deals with the amount of compensation due.  Quantum is divided into 2 areas known as ‘general damages’ and ‘special damages’.  General damages mainly concern the extent, type, severity and recovery time for an injury. Special damages then cover calculable figures such as for loss of earnings, medical fees and travel expenses.

    • The Injuries Board will allow a 90 day period to ascertain whether a respondent is consenting to the assessment process.
    • Once the Injuries Board embark on an assessment, they will aim to provide this within 9 months, although this period can be extended by a further 6 months.
    • If either party rejects the Injuries Board assessment, an ‘authorisation’ is issued.The authorisation is then required in issuing court proceedings

    How we can help
    A vital part in putting together any claim for personal injury involves obtaining a medical report. It is usual in Ireland for the treating medical practitioner to furnish such a report on request.

    All personal injury case cases must first be submitted to the Personal Injuries Assessment Board under which legal costs are not usually allowed. If a case then proceeds to court, costs are generally awarded in favour of the winning party.

    The purchase or sale of the family home can often become one of the most stressful events anyone can experience.

    This is often because this is not only one of the largest investments a person will make in their lifetime, but this can also represent a good deal of emotion in saying goodbye to a property where so many important family events have taken place, or conversely where people intend to settle down with their lives and families. At Philip Vint & Co. Solicitors we understand this and exercise the greatest care in delivering the best possible service to you.
    In most situations, the purchase or sale of property broadly involves a three step process.

    • Stage one ends with the “exchange of contracts” which means that both the seller and purchaser have entered into a legally binding agreement that the property will be transferred. At this point the balance of a deposit is usually paid.
    • Stage two involves the actual transfer of the property itself. This is done by both parties completing a deed of transfer and the total balance of monies due being paid.
    • By the end of stage two, the transaction is completed, however, registration of the property still needs to take place at stage three. This entails final registration of the property (and any mortgage) with a central registration authority known as the Land Registry.
